Introduction

1.1. These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (the “User”) and HUBBY eSIM, a provider of international eSIM services designed to allow travelers to stay connected while abroad. By using HUBBY eSIM, you agree to these Terms and Conditions.

1.2. This Agreement applies exclusively to the purchase of prepaid eSIMs from HUBBY for personal use on your device.

1.3. We recommend that you retain a copy of these Terms and Conditions for future reference.

2. Purchase of eSIMs and Activation​

2.1. By purchasing an eSIM through the HUBBY website or app, you agree to pay all applicable charges for the eSIM and the selected data plan. Payments can be made via Credit Card, PayPal, Google Pay, Apple Pay, or iDeal. All transactions are secured through our trusted payment providers.

2.2. The User must ensure that their device is eSIM-compatible and network-unlocked. HUBBY will provide a list of compatible devices at checkout. However, the User is responsible for ensuring their device is compatible, as this may vary based on carrier and country.

2.3. After purchasing an eSIM, the User will receive an email containing installation instructions and a secure link to download the eSIM profile via their HUBBY account.

3.Duration and Termination

3.1. The Agreement between HUBBY and the User starts once the eSIM purchase is confirmed. The downloaded eSIM remains active on the User’s device until the purchased data plan is fully used or has expired.

3.2. The User can remove the eSIM at any time from their device settings, but it is recommended to do so only after the data plan is fully consumed or has expired.

3.3. HUBBY reserves the right to terminate this Agreement if the User breaches any of these Terms and Conditions.

 

4. Service Availability

4.1. HUBBY will take commercially reasonable steps to ensure the eSIM service is available at all times. However, HUBBY does not guarantee uninterrupted service due to factors outside its control, including but not limited to network maintenance, device compatibility, or regional network restrictions.

4.2. HUBBY partners with multiple service providers to deliver connectivity, but the User’s experience may vary depending on their location and the network availability in that region.

5. Refund Policy

5.1. HUBBY offers refunds for technical issues that prevent the activation of the eSIM, provided troubleshooting efforts have been unsuccessful. Refund requests must be submitted within 30 days of purchase.

5.2. If the eSIM has already been activated, refunds will only be granted for the remaining, unused data if HUBBY is unable to resolve an issue originating from its service.

5.3. Refunds will not be granted for device incompatibility if the eSIM has been activated or if the User failed to check device compatibility before purchase.

6. User Obligations

6.1. The User must not engage in any fraudulent, illegal, or abusive activities that could damage HUBBY's services or network. Such actions may result in suspension of the User’s eSIM service without prior notice.

6.2. Users are responsible for keeping their account information secure and should not share their account details with unauthorized parties.

6.3. The User is responsible for ensuring that the eSIM is used in accordance with all applicable laws and regulations in their country of use.

7. Liability

7.1. HUBBY is not liable for any interruptions, delays, or errors in service caused by external factors beyond its control, including network provider issues, device incompatibility, or other unforeseen circumstances.

7.2. HUBBY’s liability, in any event, is limited to the amount paid by the User for the eSIM and related data plan.

 

8. Privacy and Data Protection

8.1. HUBBY will collect and process personal data in accordance with its Privacy Policy. This data will be used to manage the eSIM service and improve the User experience.

8.2. HUBBY ensures compliance with data protection laws, including the General Data Protection Regulation (GDPR).

 

9. Governing Law

9.1. These Terms and Conditions are governed by and construed in accordance with the laws of the Netherlands.

9.2. Any disputes arising under these Terms and Conditions will be resolved in the courts of the Netherlands.
